The Williamson County Sheriff's Office TN will conduct a Sheriff Sale on Tuesday, March 14, 2023 at 12 noon at the front door of the Williamson County Judicial Center, 135 S. 4th Avenue, Franklin, TN.  A parcel of land with a home at 701 Murfreesboro Road, Franklin, TN is scheduled to be auctioned.  A minimum bid will be set.  The home is currently occupied, so please do not disturb the residents.   

NOTICE OF SHERIFF’S SALE OF REAL PROPERTY

 By virtue of an execution and Levy issued by the Chancery Court of Williamson County, Tennessee, in Danielle Catherine Dunn, Petitioner vs. Matthew David Dunn, Respondent, Williamson County Chancery Court Docket No. 2018-CV-47037 M, as well as that Order entered on September 3, 2022 (the “Sale Order”), the Williamson County Sheriff’s Department (“Sheriff”) will offer for sale to the highest bidder, for cash, the interest of Matthew D. Dunn in the following real property: (a) the Land at 701 Murfreesboro Road, Franklin, Tennessee, Instrument number 13048500; which is described as follows: 

 Street Address: The street address of the property is 701 Murfreesboro Road, Franklin, Tennessee, 37064, Instrument number 13048500, but such address is not part of the legal description of the property. In the event of any discrepancy, the legal description herein shall control.

 Legal description: The real property is described in the Warranty Deed, conveying the property to Matthew D. Dunn and Wife, Danielle C. Dunn, dated October 16, 2013, of record at Book 6058, Page 330-331, Register’s Office for Williamson County, Tennessee, as follows:

     Land situated in the Ninth Civil District of Williamson County, Tennessee, within the corporate limits of the City of Franklin and being more particularly described as follows:

Beginning at an iron pin in the northerly boundary line of Tennessee Highway 96 (Murfressboro Road), and point also being in the easterly margin of Eddy Lane; thence along the northerly boundary of Tennessee Highway 96 South 89º21ꞌ 30ꞌꞌ E 127.9 feet to a point: thence North 2º 01ꞌ E 470.6 feet to an iron pin; thence North 86º 00ꞌ W 141.8 feet to an iron post; thence along the easterly margin of Eddy Lane South 1º 39ꞌ W 457.5 feet to a point; thence continuing along the margin of Eddy Lane in a southeasterly direction South 25º 10ꞌ E 23.9 feet to the point of beginning; containing 1.52 acres, more or less according to survey of C.K. McLemore dated October 27, 2976.

     Being the same property conveyed to Nathan Grigsby Sawyer and wife, Anita W, Sawyer by deed from Ethel M. Grigsby, widow of Blythe Grigsby, of record in Book 302, page 125, Register’s Office for Williamson County, Tennessee.

     INCLUDED IN THE ABOVE PROPERTY DESCRIPTION BUT EXPRESSLY EXCLUDED THEREFROM IS THE FOLLOWING DESCRIBED PROPERTY;

     A parcel of land in the 9th Civil District, Williamson County, City of Franklin, Tennessee, this is more particularly described as follows:

 Beginning at an iron pin in the northerly boundary line of Tennessee Highway 96 (Murfressboro Road), said point being in the easterly margin of Eddy Lane;

     Thence S 89 deg 21ꞌ 30ꞌꞌ E, 21 feet to a point;

     Thence N 18 deg 14ꞌ 27ꞌꞌ W, 72 feet to a point;

     Thence N 4 deg 37ꞌ 27ꞌꞌ W, 64 feet to a point;

     Thence S 1 deg 39ꞌ 00ꞌꞌ W, 110 feet to a point;

     Thence S 25 deg 10ꞌ 00ꞌꞌ E, 24 feet to the point of beginning.

     Containing 1,416 square feet (0.0325 acre), more or less.

Being the same property conveyed to the City of Franklin by Right-of Way Deed form Nathan G. and Anita W. Sawyer of record in Book 1414, page 834, Register’s Office for Williamson County, Tennessee.      This Conveyance is subject to the following:

a. Williamson County taxes for the year 2013 are a lien against said property and are due and payable.  Said taxes have been prorated between the parties as of the date of the instrument, with GRANTEE paying its prorate part thereof to the GRANTOR, who will be responsible for payment of said taxes. Map/Parcel 078-64.00.

b. Agreement for Dedication of Easement for Sanitary Sewer Main of record in Book 143, page 545 and Book 631, page 680, Register’s Office for Williamson County, Tennessee.

c. Easement for water and gas lines and maintenance thereof described in instrument of record in Book 302, page 125, Register’s Office for Williamson, County, Tennessee.

 This is IMPROVED property known as 701 Murfressboro Road, Franklin, Tennessee 37064  

 This sale is made pursuant to Tenn. Tr. Civ. 69.07(4), Tenn. Code Ann. 26-5-101 et. Seq., and the Order entered on September 3, 2022, and is in satisfaction (whole or in part depending on proceeds of sale) of the judgement in favor of Danielle Dunn in the Order entered on July 24, 2022, which has been recorded as a judgement lien with the Williamson County Register of Deeds Office on August 9, 2022, and second judgment entered by Order September 13, 2022, which was recorded on October 6, 2022. 

 All property is sold “as is.” No warranties or guarantees are made, expressed or implied. There are no interested parties other than the Plaintiff-judgement creditor and the debtor to whom notice must be given. There are no tax liens of record requiring notice. Redemption rights and equity redemption are waived. 

 At 12:00 o’clock P.M., on the 14th  day of March, 2023, at the front door of the Williamson County Judicial Center, 135 S. 4th Avenue, Franklin, Tennessee, 37064, the Sherriff will sell the above property for payment toward said Judgement together with all expenses and legal costs accruing.

 TERMS OF SALE: Cash, Certified Check, or Receipt on Judgement from Petitioner. Pursuant to Order Directing Execution Sale of Real Property Pursuant to a Judgement Lien: Matthew Dunn is entitled to a Homestead Exemption of $5,000.00 which sum is to be exempt from execution, set aside from proceeds of the sale, and returned to Mr. Dunn. High bidder will be required to execute a written sale agreement at conclusion of bidding, with customary terms (including a deposit of ten (10%) percent of bid price to be held in trust by Petitioner’s attorney); Pursuant to Tenn. Code Ann.  26-5-115, bidding will start at 50% of appraised value. The sale shall be approved and confirmed by the Williamson County Chancery Court, the Court which issued the process directing this Sale; and the Sheriff shall provide the deed described at Tenn. Code Ann.   26-5-111 after entry of the order of confirmation of the sale, at which time purchaser(s) will pay the remainder of the purchase price; and counsel for Petitioner shall act as closing agent for the Sale(s). Proceeds of the sale shall be applied first to the Sheriff’s statutory fees and reasonable expenses, then to court costs, then to the Plaintiff-judgement creditor, then $35,000 to be deposited with the Clerk of the Williamson County Chancery Court pursuant to the January 2, 2023 Order and then any remaining balance to Matthew Dunn as judgement debtors. 

 As to all or any part of the Property, the right is reserved to (i) delay, continue or adjourn the sale to another time certain or to another day and time certain, without further publication and in accordance with law, upon announcement of said delay, continuance or adjournment on the day and time and place of sale set forth above or any subsequent delayed, continued or adjourned day and time and place of sale; (ii) sell at the time fixed by this Notice or the date and time of the last delay, continuance or adjournment or to give new notice of sale; (iii) and/or to sell to the next highest bidder in the event any high bidder does not comply with the terms of the sale.
